1. Right of Withdrawal

In accordance with Portuguese law, consumers have the right to withdraw from a distance contract or off-premises contract within a period of 14 days without giving any reason. The withdrawal period shall expire 14 days after the day on which the consumer or a third party, other than the carrier, acquires physical possession of the goods or, in the case of multiple goods ordered in one order, the day on which the consumer or a third party, other than the carrier, acquires physical possession of the last good.

To exercise the right of withdrawal, the consumer must inform the seller of his decision to withdraw from the contract by an unequivocal statement (Point 4)

The consumer must return the goods to the seller without undue delay and in any event not later than 14 days after the day on which he communicated his withdrawal from the contract to the seller. The consumer shall bear the direct cost of returning the goods.

2. Exceptions to the Right of Withdrawal

The right of withdrawal does not apply to the following types of contracts:

  • The supply of goods or services that are personalized or custom-made.
  • The supply of sealed goods which have been unsealed after delivery and cannot be returned for reasons of health protection or hygiene.
  • The supply of goods which, by their nature, are likely to deteriorate or expire rapidly.
  • The supply of sealed audio or video recordings or sealed software which have been unsealed after delivery.
  • The supply of newspapers, periodicals, or magazines with the exception of subscription contracts for the supply of such publications.
  • Contracts for the provision of accommodation, transport, restaurant and catering services, leisure activities, or services related to leisure activities.
  • Contracts for the provision of digital content not delivered on a physical medium.

3. Refunds

If the consumer withdraws from the contract, the seller shall reimburse all payments received from the consumer, including the cost of delivery, without undue delay and in any event not later than 14 days after the day on which the consumer informed the seller of his withdrawal from the contract. The seller shall reimburse the consumer using the same means of payment as used by the consumer for the initial transaction, unless the consumer expressly agrees otherwise and provided that the consumer does not incur any additional charges as a result.

The compensation will only be issued once the email [template above] is sent and the return package is delivered and verified.
